The affidavit said the judge refused to let deputies into his home, so they had to break open the door. A cellular phone was seized containing photos used on the fake web ads and evidence of several visits to the web site where the ads were placed using his former girlfriends' Facebook photos .

The former state judge from Galveston 43 was arrested and charged with two counts of online harassment for allegedly placing fake online ads using two former girlfriends' Facebook photos.
The creator of the ad masked his identity by using Internet services in Germany and Venezuela, the complaint said. Sheriff's investigator Scott Hardcastle subpoenaed for the user name used to create the web pages, Don Tequilla. The name was traced to the ex judge Dupuy, the complaint said.

 Threats, slurs, and posting someone's personal information, or photos without their consent is not protected speech meaning those things are not covered under freedom of speech. The courts have been very clear on that. Speech used as part of a crime is not covered by freedom of speech. Harassment is a crime.
